Terms of Service

1. Who we are

Fishtailz is operated by Fishy Business 2026 Limited (NZBN 9429053728753), a company registered in New Zealand ("Fishtailz," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Fishtailz website, mobile applications, and related services (collectively, the "Service").

By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to create a paid Fishtailz account. If you are under 18, you confirm you have a parent or guardian's permission to use the Service. We reserve the right to request verification of age and to suspend or terminate accounts where we reasonably believe this requirement has not been met.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must provide accurate information when registering and keep it up to date.
• You must notify us promptly if you become aware of unauthorised use of your account.
• We may suspend or terminate accounts that violate these Terms, provide false information, or are inactive for an extended period, subject to applicable law.

4. The Service

Fishtailz provides tools for fishing clubs, competition organisers, and individual anglers, including but not limited to: club and membership management, competition entry and leaderboards, personal trip and catch logging, and social features allowing users to share activity with other users.

We may add, change, or remove features at any time. We'll make reasonable efforts to notify users of material changes that affect their use of paid features.

5. Free tier and paid tier

• Fishtailz offers a permanent free tier — this is not a limited-time trial and does not automatically convert to a paid plan.
• We offer one optional paid tier with additional features, billed via Stripe Checkout. Current pricing is displayed at the point of purchase.
• Club-level membership pricing, sponsor/advertiser placements, and discount codes are separate offerings from the individual paid tier and may be subject to additional or different terms communicated at the point of sale.

6. Payments

• All payments are processed by Stripe, Inc. ("Stripe"), a third-party payment processor. We do not store your full payment card details — these are handled entirely by Stripe under its own terms and privacy practices.
• By making a payment, you also agree to Stripe's Services Agreement.
• Prices are inclusive of New Zealand GST where applicable, as indicated at checkout.
• Fishtailz does not provide refunds — including prorated refunds for any unused portion of a billing period — for early cancellation, downgrade, or change of mind on either monthly or yearly plans. This does not limit any right or remedy you may have under the Consumer Guarantees Act 1993 or other applicable law.
• Subscription cancellations take effect at the end of the current billing period unless otherwise stated.

7. User content

• "User Content" means trip logs, catch records, photos, competition entries, comments, and any other content you submit to the Service.
• You retain ownership of your User Content. By submitting it, you grant Fishtailz a non-exclusive, worldwide, royalty-free licence to host, store, display, and distribute it as necessary to operate the Service (for example, showing your catch log to people you're connected with).
• You're responsible for ensuring you have the right to share any content you post, including photos featuring other people.
• We may remove User Content that violates these Terms or applicable law.

8. Location and trip-tracking data

Fishtailz's trip-tracking features may collect GPS location data during active use. This data is used to power trip history, mapping, and related features as described in our Privacy Policy. You control what location data is shared with other users versus kept private, via in-app settings.

9. Fishing regulations and safety

You are solely responsible for complying with all applicable fishing regulations, catch limits, licensing requirements, and safety practices in your jurisdiction. Fishtailz provides tools for logging and tracking activity — it does not verify compliance with fishing regulations and is not a substitute for official regulatory information.

10. Acceptable use

You agree not to:

• use the Service for any unlawful purpose;
• misrepresent catch data, competition entries, or results with intent to defraud or gain unfair advantage;
• harass, abuse, or harm other users;
• attempt to gain unauthorised access to the Service or other users' accounts;
• scrape, reverse-engineer, or interfere with the normal operation of the Service;
• upload content that is unlawful, defamatory, or infringes another person's rights.

We reserve the right to suspend or terminate accounts that breach this section.

11. Sponsors, advertising, and third-party links

The Service may display sponsor content, banner advertisements, or links to third-party websites (including club or sponsor websites). We don't control and aren't responsible for third-party content or sites you access through the Service.

12. Intellectual property

The Fishtailz name, logo, and branding are the property of Fishy Business 2026 Limited. FISHTAILZ is the subject of a pending trademark application filed with the Intellectual Property Office of New Zealand (IPONZ). Except for User Content, all other content and software making up the Service is owned by or licensed to us and may not be copied or used without permission.

13. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. Nothing in these Terms excludes or limits any guarantee, right, or remedy you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded.

14. Limitation of liability

To the maximum extent permitted by law, Fishy Business 2026 Limited is not liable for any indirect, incidental, or consequential loss arising from your use of the Service, including loss of data, loss of profits, or loss arising from reliance on trip or catch data. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months before the claim arose.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, or for operational or legal reasons, with notice where reasonably practicable.

16. Changes to these Terms

We may update these Terms from time to time. We'll indicate the "Last updated" date above and, for material changes, provide reasonable notice (e.g. via email or an in-app notice) before the changes take effect.

17. Governing law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.
